These Terms of Service ("Terms") govern your access to and use of the PulseKit mobile application and related services (collectively, the "App"). These Terms constitute a legally binding agreement between you and PulseKit ("we," "us," or "our"). By downloading, installing, accessing, or using our App, you acknowledge that you have read, understood, and agree to be bound by these Terms.
By downloading, installing, accessing, or using our App, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you may not download, install, access, or use our App.
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms within the App or by other reasonable means. Your continued use of the App after any such changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App and uninstall it from your device.
To use our App, you must be at least 13 years old. If you are under 18 years old, you must have permission from your parent or legal guardian to use the App, and they must agree to these Terms on your behalf. By using the App, you represent and warrant that you meet these eligibility requirements.

PulseKit allows you to connect third-party services you choose. Any access is read-only and used only to display metrics as widgets. We do not modify, sell, or share this information. You can disconnect integrations at any time.
The App may offer in-app purchases or subscription services. All purchases and subscriptions are subject to the following terms:
You retain ownership of any User Content you submit, but you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such User Content in any media.
You represent and warrant that you have all necessary rights to grant this license and that your User Content does not violate any third-party rights or applicable laws.
We reserve the right to remove any User Content at our discretion.

All content provided by PulseKit, including design, text, graphics, logos, icons, images, and software, is the property of PulseKit or its content suppliers.
PulseKit trademarks may not be used without our prior written consent.

PulseKit is not responsible for third-party websites or services linked within the App. Your interactions with such websites are at your own risk.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. PULSEKIT DOES NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR VIRUS-FREE.
Our maximum aggregate liability for any single event shall not exceed the amount paid by you in the previous 12 months, except where prohibited by law.
You agree to indemnify and hold harmless PulseKit and its agents against claims arising from your use of the App, User Content, or violation of these Terms.
These Terms are governed by EU law and the laws of your country of residence.
You may bring legal proceedings in your country of residence or use the European Commission's Online Dispute Resolution platform.
These Terms and our Privacy Policy constitute the entire agreement between you and PulseKit.
A failure to enforce a provision does not waive it. If any provision is unenforceable, remaining provisions stay in effect.
We may suspend or terminate your access to our App at any time. Upon termination, your license to use the App ends immediately.
These provisions apply to users protected by European Union regulations.
We collect and process your personal data only when we have a lawful basis. We collect only what is necessary and allow you to withdraw consent at any time.
We adhere to GDPR principles: lawfulness, fairness, transparency, purpose limitation, data minimization, accuracy, storage limitation, and integrity.
If you are in the EEA, you have rights to access, correct, erase, restrict processing, port your data, object to processing, and request human review of automated decisions.

Some features require age verification. You may be asked to provide proof of age. Providing false information may result in termination.
